What is a patent agent?

A patent agent can represent his/her clients in front of the US Patent and Trademark Office (USPTO) for anything related to a patent. They can help clients prepare, file, and defend patent applications. To become a patent agent, someone must have a technical degree and then must pass the United States Patent and Trademark Office's Patent Bar exam.

  1. A patent agent helps you to secure your invention with a patent. Although you can file for a patent application on your own, involving a patent agent is strongly advised.

  2. A patent agent can help you to manage objections and corrections from the USPTO's patent examiners. They can help you to make the application process smoother and quicker.

  3. A patent agent can help you to save money and time while keeping a business focus. Your patent is a business tool and should be drafted with your business strategy in mind. A patent agent can keep you focused on your business, not just your technology when drafting your patent application.

  4. Though they have many similarities, a patent agent is not a patent attorney, and can't go to court when there is patent infringement. Of course, many patent attorneys also don’t go to court (litigate).
